I went through an orange light just after New Years day in Glasgow town centre. As i approached the lights they changed and I felt it was dangerous to slam on my brakes because of a bus, just inches behind me. Unfortunately the police were sitting at the junction and they pulled me over. They said I am getting a ticket for running a red light but I explained it was orange. What happens next. I do have three friends who were all in the car with me and can confirm it would have been crazy to slam on the brakes.
Amber or Orange means stop however you do have a defence. if it would have caused danger to other road users (Bus and passengers) then you are entitled to run the light. It depends very much on circumstances such as weather conditions, stopping distance and speed. I would say it sounds like you should refuse to pay the fixed penalty that you will receive and thereafter plead Not Guilty to the copy Complaint that will be served on you.You should seek representation for your trial. If you are of limited means (Unemployed) then you may qualify for legal aid however it is likely that legal aid would be refused on the basis that it is not a serious enough matter to warrant public expenditure or is simply "not in the interests of justice" Defending the case can be expensive so you need to weigh up the personal cost to you.
